  3. Reference to “you” in these General Conditions refers to the entity making an application to the Funds and to any individual producer, writer and director referenced in your application.

  4. All applications must be submitted via the submissions platform, Zealous, which is accessible via our website. The information contained on our website may be subject to change. We reserve the right to review and to change such information and the Funds at any time, at our discretion. We will not be responsible for any loss attributable to errors, omissions or other inaccuracies in the information contained on our website.

  5. In addition to the information provided on the Funds application form, we may request further information from you and/or undertake our own research in order to decide which applications shall receive funding under the Funds. You agree to provide such further information promptly. Should you fail to do so, your application may ultimately be rejected.

  6. We will not process applications which are incomplete, or which do not comply with the guidelines or these General Conditions. Please check your application form carefully before submitting it.

  7. You shall comply with all rules and regulations in force at any places that you attend in connection with the Funds, for example our London office for an interview.

  8. No funding will be provided unless and until we have received a fully executed copy of our funding agreement and any conditions precedent have been satisfied.

  9. We will withhold or reclaim an award in the following circumstances at our sole discretion: (i) if the application was filled in dishonestly or with incorrect or misleading information about you or the project (whether deliberately or accidentally); and (ii) if the award recipient acts dishonestly, recklessly or negligently to the disadvantage of the project. We may follow up cases of suspected fraud, piracy and/or copyright infringement and may pass such information to the police, if applicable.

  10. Applicants acknowledge and agree that due to the nature of our businesses and that of other individuals and entities involved in the Funds (referred to collectively as our “Partners”), similar ideas and themes may be coincidentally developed and/or produced in current and future productions made by us and/or our Partners and we and/or our Partners shall have no liability to you in respect of such similar content.

  11. In submitting your application, you confirm (i) that any individual named in your application consents to our publication of their name, for example, but not limited to publication on our website; and (ii) that if your application is successful, any recipients of any funds/awards and those involved in the project consent to the use of their name, photograph and biography.

  12. All applications are made at your own risk. We shall not be liable to you, directly or indirectly for:

    12.1.        any loss or damage, howsoever caused, to your property sustained at, or whilst in transit to or from, places at which you attend as part of this application process;

    12.2.        to the extent permitted by law, for any personal injury, ailment or death arising out of or in the course of, your attendance at any event connected with the application process, except to such extent, if at all, assuch injury, ailment or death is caused by our negligence; and

  13. For the purpose of creating a statistical picture of the interests of filmmakers working in the United Kingdom we may, from time to time, share anonymised data pertaining to any and/or all of the feature films and short films which are submitted to us as part of an application. Such data may include, but shall not be limited to the identity of any protagonists, the nature of any themes, the film’s setting, genre and/or story beats (“project data”). Project data will be stored in accordance with our Privacy Policy.

  14. Whilst all applicants are required to submit the form, active participation in the monitoring is voluntary: ‘prefer not to say’ is an acceptable response to all questions on the EDI Form. The equality, diversity and inclusion data (“EDI Data”) that we gather from the EDI Form is anonymous. It is kept separate from the project application forms and is not used as part of assessing projects. We may from time to time share the anonymous EDI Data with our Partners and selected third parties for reasons including but not limited to, assistance with analysis.
